USING THE SERVICE

Use of the Service may be available through a compatible Internet browser or mobile device and may require network connections and software. You agree that you are solely responsible for these requirements, including any applicable changes, updates and fees as well as the terms of your agreement with your mobile device and telecommunications provider. You are only entitled to access and use the Service for lawful purposes. You agree that Provider may use your feedback, suggestions, or ideas in any way, including in future modifications of the Service, other products or services, advertising or marketing materials. You grant Provider a perpetual, worldwide, fully-transferable, sub-licensable, irrevocable, fully paid-up, royalty-free license to use the feedback you provide to Provider in any way. You further agree that you will not: (i) use any robot, spider, scraper, deep link or other similar automated data gathering or extraction tools, program, algorithm or methodology to access, acquire, copy or monitor the Service or any portion of the Service; (ii) post or transmit any file which contains viruses, worms, Trojan horses or any other contaminating or destructive features, or that otherwise interfere with the proper working of Provider or the Service; or (iii) attempt to decipher, decompile, disassemble, or reverse-engineer any of the software comprising or in any way making up a part of the Service.

We offer services and products through App (otherwise known as “In-App”) purchasing.

You hereby acknowledge and accept that by making any such In-App purchase(s) that any ancillary terms to that purchase bind you to the terms and conditions already set out herein.

You acknowledge and agree that when you make any In-App purchase, it may be processed by third-party host platforms, for example, Google Play Store or the Apple App Store.

In the alternative, you may use an authorised debit/credit card or Paypal account; wherein, these payment methods are processed by a third-party vendor.

You agree to hold us harmless for any loss incurred through any third-party processed transactions and or information sharing.

By making an In-App purchase you give us full permission to process the transaction through your chosen payment method. If for whatever reason your payment fails and or is reversed, you agree to remit any monies due to us in full.

Subscribers agree and acknowledge that purchases of any special limited-use features (“In-App Item(s)”) made through our service(s) are non-refundable and final.

Any In-App Items expire or are unusable when the user’s account is closed/ disabled/ or otherwise made inactive, and no compensation may be claimed as against any In-App Item(s).

Subscriptions

Subscription automatically renews unless auto-renew is turned off least 24-hours before the end of the current period.
Account will be charged for renewal within 24-hours prior to the end of the current period, and identify the cost of the renewal
Subscription may be managed by the user and auto-renewal may be turned off by going to the user’s Account Settings after purchase
Any unused portion of the free trial period, if offered, will be forfeited when the user purchases a subscription to that publication where applicable
The Lifetime Premium Package is available for a one-time payment. There are no recurring charges associated with this purchase.
Except as applicable law requires, the Lifetime Premium Package is non-refundable once purchased. Please ensure that you are committed to this purchase before proceeding.
Our Lifetime Premium Package complies with all Apple App Store and Google Play Store policies and guidelines. Any policy updates may result in modifications to these terms to ensure continued compliance.

Duration & Renewal

We offer a monthly/yearly/lifetime subscription. In addition, we reserve the right to offer and or retract trial periods of our service(s). Any trial periods, free or otherwise, are governed by the same terms and conditions herein.

Any subscription, paid or otherwise, will be limited to one email address.

Subscriptions are automatically tacitly renewed for the same duration as the user’s initial subscription; unless terminated in accord with these Terms or if their payment method fails.

All trial subscriptions automatically convert into a monthly subscription at the fee indicated to the user at the time of activating the trial period unless terminated in accord with these Terms or if their payment method fails.

We will notify you of any subscription increases in advance of your renewal date. If you do not cancel the subscription in line with these Terms, you are deemed to have accepted any said fee increase.

Termination

Subscribers have the right to cancel any subscription by giving 24-hours notice before the subscription falls due for the upcoming subscription period. Otherwise, all subscriptions perpetually automatically renew. No subscription due for renewal can be cancelled within the 24-hour period immediately beforehand.

Where a subscription is purchased via a third-party platform, such as the Apple App Store, the subscriber must select their “Account” and follow the instructions to terminate the subscription. Please note, that conditions vary between third—party platforms and we accept no responsibility for your inability to navigate said platforms. Any period remaining of your subscription may be used up until your subscription expires.

We reserve the right to suspend access to any subscriber (including Premium account holders) and or terminate any subscription without refund where a subscriber infringes our intellectual property rights; attempts to bypass our security measures; provide false or misleading information regarding their subscription; repeatedly violates these Terms and conditions, or there is a default of payment by the subscriber.This condition shall exist regardless of the length of membership.

Refund

Subscribers agree that a contract between them and us starts at the time of validating their usage of the service(s). They acknowledge and agree that they lose all right to withdraw for the current period of subscription at that date. Users accept that no request for cancellation, refund, or revocation will be entertained once a subscription period starts.

WHAT ARE ELECTRONIC COMMUNICATIONS PROTOCOLS AND COOKIES AND HOW DO WE USE THEM?

We may store information that we collect through cookies, log files, clear gifs, and/or third parties to create profiles of our users. A profile is stored information that we keep on individual users that detail their viewing preferences. Consequently, collected information is tied to the users’ personally identifiable information to provide offers and improve the content of the Platform for the user. This profile is used to tailor a user’s visit to the Platform, and to direct pertinent marketing promotions to them. We do not share your profile with other third parties.

Cookies

A cookie is a piece of data stored on the user’s computer tied to information about the user. Usage of a cookie is in no way linked to any personally identifiable information while on our Platform. We use both session ID cookies [and] persistent cookies. For the session ID cookie, once users close the browser, the cookie simply terminates. By setting a cookie on our Platform, users would not have to log in a password more than once, thereby saving time while on our Platform. If users reject the cookie, they may still use our Platform. The only drawback to this is that the user will be limited in some areas of our Platform. For example, the user will not be able to participate in any of our sweepstakes, contests or monthly drawings that take place. Persistent cookies enable us to track and target the interests of our users to enhance the experience on the Platform.

How Do We Use Your Data?

To Engage In Transactions For Service: Your name, address, email, purchase details, and credit card/payment information may be collected and stored as part of the transaction history and may be used by us to enable us to perform the Services.

These updates are related to product releases, prices, terms, special offers and associated campaigns. This data is sent when the program member signs up for the relevant program or online account.
For EarthSnap, Inc.’s Marketing to You. We may use information from user purchases and user-specified requirements to provide you with timely and pertinent notices regarding product releases and service developments that address your needs and specified requirements and/or which are similar to services previously purchased by the user from us.
For Third-Party Advertising to You. We may use information derived from cookies, location data (if you allow it) or your behavior on the Platform to allow us and third parties to target certain ads towards you while you use the Platform. The ads appearing on the Platform are delivered to users by our ad serving software. Information about users’ visit to this Platform, such as number of times they have viewed an ad (but not user name, address, or other personal information), is used to serve ads to users on this Platform. To Place Cookies on Your Browser. In the course of serving advertisements to this Platform, our third-party advertiser may place or recognize a unique cookie on your browser.
To Use Log Files. Like most standard web site servers we use log files. This includes internet protocol (IP) addresses, browser type, internet service provider (ISP), referring/exit pages, platform type, date/time stamp, and number of clicks to analyze trends, administer the Platform, track users’ movement in the aggregate, and gather broad demographic information for aggregate use. IP addresses, etc. are not linked to personally identifiable information. We use a tracking utility called ‘ClickTracks’ that uses log files to analyze user movement.
To Use Clear Gifs. We employ a software technology called clear gifs (a.k.a. Web Beacons/Web Bugs), that help us better manage content on the Platform by informing us what content is effective. Clear gifs are tiny graphics with a unique identifier, similar in function to cookies, and are used to track the online movements of Web users. The main difference between the two is that clear gifs are invisible on the page and are much smaller, about the size of the period at the end of this sentence. Clear gifs are not tied to users’ personally identifiable information. Clear Gifs can “work with” existing cookies on a computer if they are both from the same Platform or advertising company. That means, for example, that if a person visited ‘www.companyX.com’, which uses an advertising company’s clear gif, the web site would match the clear gif’s identifier and the advertising company’s cookie ID number, to show the past online behavior for that computer. In addition, we use clear gifs in our HTML-based emails to let us know which emails have been opened by the recipients. For Special Offers. We send all new members a welcoming email to verify password and username. Established members will occasionally receive information on products, services, special deals, and a newsletter. Out of respect for the privacy of our users we present the option to not receive these types of communications. Please see the Choice and Opt-out sections.
For Newsletters. If a user wishes to subscribe to our newsletter, we ask for contact information such as name and email address.
For Service Announcements. On rare occasions it is necessary to send out a strictly service related announcement. For instance, if our Service is temporarily suspended for maintenance we might send users an email.
For Customer Service. We may communicate with you on a regular basis to provide the Services and any other requested services, and in regards to issues relating to their account we reply via email or phone, in accordance with the users wishes.

DOES EARTHSNAP, INC. COLLECT ANY FINANCIAL DATA?

No. EarthSnap, Inc. utilizes Google and Apple to process all financial transactions and EarthSnap, Inc. is not provided with any data or personal information related to your transaction.

We will only share your data for the limited marketing purposes as set forth in this Privacy Policy and with other vendors for purposes of performing the Services and operation of the Platform.

We may share your data in an aggregated, de-identified manner with third-party marketing companies as set forth in this Privacy Policy. We do not share your data with any third-parties to perform the Services except that various vendors that are performing maintenance on the Site may have limited temporary access to your information. We may provide your personal information to third-party payment processors or order fulfillment vendors for purposes of providing the Services to you. We may also need to share your personal information for purposes of disclosing to law enforcement if required by law. We do not share your personal information other than your location data (if you allow us) with third-parties for advertising purposes

It is necessary for us to use your personal information to perform our obligations in accordance with any contract that we may have with you or it is in our legitimate interest or a third party’s legitimate interest to use personal information in such a way to ensure that we provide the Services in the best way that we can. We have a legitimate business interest to create business opportunities for our company in sharing aggregated demographic information with our partners and advertisers that may be based on your aggregated, de-identified personal information. Business Transitions

In the event EarthSnap, Inc. goes through a business transition, such as a merger, being acquired by another company, or selling a portion of its assets, users’ personal information will, in most instances, be part of the assets transferred. If as a result of the business transition, the users’ personally identifiable information will be used in a manner different from that stated at the time of collection they will be given choice consistent with our notification of changes section.

Surveys and Contests

From time-to-time the Platform requests information from users via surveys or contests. Participation in these surveys or contests is completely voluntary and the user therefore has a choice whether or not to disclose this information. The requested information typically includes contact information (such as name and shipping address), and demographic information (such as zip code). Choice/Opt-out

Each of our users are given the opportunity to ‘opt-out’ of having their information used for purposes not directly related to the Platform at the point where we may ask for your personal information. For example, our order form has an ‘opt-out’ mechanism so users who buy a product from us, but don’t want any marketing material, can keep their email address off of our lists.

Users who no longer wish to receive our newsletter and promotional communications may opt-out of receiving these communications by replying to unsubscribe in the subject line in the email.

Users of our Platform are always notified when their information is being collected by any outside parties. We do this so our users can make an informed choice as to whether or not they should proceed with services that require an outside party.

EarthSnap, Inc. takes every precaution to protect our users’ information. When users submit personal information via the Platform, their information is protected both online and off-line. The personal information that you provide to us is stored on servers, which are located in secured facilities with restricted access, and protected by protocols and procedures designed to ensure the security of such information. In addition, we restrict access to personal information to Provider employees, independent contractors and agents who need to know this information in order to develop, operate and maintain the Service. However, no server, computer or communications network or system, or data transmission over the Internet can be guaranteed to be 100% secure. As a result, while we strive to protect user information, we cannot ensure or warrant the security of any information you transmit to us through use of the Service and you acknowledge and agree that you provide such information and engage in such transmissions at your own risk. Once we receive a transmission from you, we will endeavor to maintain its security on our systems.

WHAT ABOUT THE PHOTOS YOU SUBMIT ON THE APP?

We encourage everyone to avoid sending any pictures that may be used to identify themselves in the photos that you upload. Please do not send any photos of yourself that would allow others to identify you. We only want photos of plants. Any use of photos with your likeness is subject to the terms of our Terms of Use.

WHAT WILL WE DO IF ANYTHING CHANGES?

If we decide to change our Privacy Policy, we will post those changes to the Platform’s homepage, and other places we deem appropriate so our users are always aware of what information we collect, how we use it, and under what circumstances, if any, we disclose it. We will use information in accordance with the Privacy Policy under which the information was collected.

For purposes of this Privacy Policy, “DP Laws” means any applicable data protection laws relating to the protection of individuals with regards to the processing of personal data including (i) EU Data Protection Directive 95/46/EC (“DP Directive”) as implemented by EU member states, (ii) the General Data Protection Regulation (EU) 2016/679 (“GDPR”), from 25 May 2018, (iii) laws implemented by EU member states which contain derogations from, or exemptions or authorizations for the purposes of, the GDPR, or which are otherwise intended to supplement the GDPR, (iv) Directive 2002/58/ec (“ePrivacy Directive”) as implemented by EU member states or in the UK (as may be updated or replaced) or any other law relating to data protection, the processing of personal data and privacy as a consequence of the United Kingdom leaving the European Union; and/or (vi) any corresponding or equivalent national laws or regulations including any amendment, update, modification to or re-enactment of such laws. Rights afforded to users that live in the European Union may be different than users with other nationalities.
